These Terms form a binding agreement between you and Lovely Something Ltd ("we", "us", "our"). We may update these Terms from time to time — continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Tooltip Tour is a software-as-a-service product that allows developers and product teams to create and deliver guided tours and tooltips within their web and iOS applications. The Service is provided via a hosted dashboard and an embeddable SDK. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where possible.
To use the Service you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 16 years old to use the Service. By registering, you confirm that the information you provide is accurate and that you will keep it up to date. You may not share your account, create accounts for others without their consent, or use the Service to impersonate another person or entity.
You agree not to use the Service to: • Distribute malware, spyware, or any malicious code • Harass, abuse, or harm other users or third parties • Scrape, reverse-engineer, or copy the Service or its underlying technology • Circumvent any rate limits, security measures, or access controls • Use the Service in a way that violates any applicable law or regulation • Resell or sublicense the Service without our prior written consent We reserve the right to suspend or terminate accounts that breach these conditions without notice.
Paid plans are billed on a recurring basis (monthly or annually) via Stripe. By subscribing you authorise us to charge your payment method on each renewal date. Upgrades take effect immediately. Downgrades take effect at the end of the current billing period. Cancellations stop future renewals but do not entitle you to a refund for any unused portion of the current period, unless required by applicable law. We reserve the right to change pricing with 30 days' notice. If you do not agree to a price change, you may cancel before the new price takes effect.
The Service, including its design, code, trademarks, and content, is owned by Lovely Something Ltd and protected by intellectual property law. You may not copy, reproduce, or create derivative works from any part of the Service without our written permission. You retain ownership of all content you create using the Service — tour steps, copy, and configurations. By using the Service you grant us a limited licence to store and deliver that content solely to provide the Service to you.
Our collection and use of personal data is described in our Privacy Policy at app.lovelysomething.com/privacy-policy. By using the Service you agree to the practices described there. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms and our Privacy Policy.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law, Lovely Something Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
You may close your account at any time from the account settings page or by emailing hello@lovelysomething.com. Closure stops future billing and queues your data for deletion within 30 days. We may suspend or terminate your account immediately if you breach these Terms, fail to pay outstanding amounts, or if we are required to do so by law. We will give reasonable notice where possible. On termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
